I got this letter from Apple when I was trying to get my laptop put all back together. All my iTunes songs were not backed up (Yes, I know that's why I got an external hard drive now) but since my hard drive , APPLE product, crashed....why would they NOT just let me have the songs back again ?
Dear Stephanie,
After researching your request, I found that on 4/1/07 you were
allowed to redownload the purchases you had made with the account
"steffoush@sbcglobal.net." This was an exception to the iTunes Store
Terms of Sale. I'm sorry, but the iTunes Store can't make another
exception for you.
The Terms of Sale are available for you to review here:
http://www.apple.com/legal/itunes/ww
Apple encourages customers to back up their hard disks regularly. If
the disk needs to be replaced, you can restore your purchases and other
data from the backup and avoid the need to purchase replacement copies
of your collection. These articles may be helpful:

SO of course I wrote a little letter back to Apple.....did you think I wouldn't.....and this is the response that I got back....
Hello Stephanie,
My sincerest apologies that your purchase history reposting was denied
before. I definitely know how upsetting this must be for you as you do
have an extensive history of purchases. My name is Vicki and please be
assured I am happy to help in any way I can.
The iTunes Store wants to give you the opportunity to redownload (at no
charge) all the titles you purchased on the account
"steffoush@sbcglobal.net" that are still available. Please note that
this is the last and final exception to re-download your purchases. Follow
these steps to redownload the available items:
1) Make sure you're using the latest version of iTunes. It can be
downloaded free of charge from the iTunes website:
http://www.itunes.com/download
2) From the Store menu at the top, choose Check for Purchases (if
you're unable to upgrade and are using iTunes 6 or earlier, you'll find this
option in the Advanced menu).
3) Enter your account name and password, then click Check. Your
purchases should begin downloading. If you receive an error message while
downloading, try again after turning off any firewall or web-accelerator
software that you may have installed.
If you want to pause your downloads and resume later, click Downloads
on the left side of iTunes, then click the Pause All button in the lower
right corner. When you're ready to resume downloading, just choose
"Check for Purchases" from the pull-down Store menu at the top, enter your
account name and password, then click the Check button.
I examined your purchase history and found that the iTunes Store has
modified or removed the following titles since you purchased them, so
they could not be added back to your account:
"Best of Ghost Hunters, Vol. 1", "Spirits of San Francisco", "Crank
That (Soulja Boy)", "Flake", "Brown Eyed Girl", "Back 2 Good", "Real

purchases on it, you can transfer them back to your computer using
iTunes 7. You'll find instructions in this article:
http://docs.info.apple.com/article.html?artnum=305465
I strongly advise that you back up your iTunes library as soon as
possible and thereafter on a regular basis as this is the final reposting of
your purchases.
